The Dominican Cassation Jurisprudence Yearbook 2023, also published by the Escuela Nacional de la Judicatura, gathers and analyzes significant decisions of the Suprema Corte de Justicia, offering interpretative studies and doctrinal commentary to strengthen coherence in the application of the law and promote legal certainty.
In this edition, Ana Magnolia Méndez Cabrera contributes the study “Perspectives on Judgment SCJ-SR-23-0001: A Land Judge’s View.” The article examines the change of criterion adopted by the Joint Chambers regarding prescription in the partition of marital community property involving registered real estate. The analysis approaches the decision from five perspectives—normative, jurisprudential, doctrinal, sociological, and economic—emphasizing its implications for the Dominican registry system and the principle of imprescriptibility under Law 108-05.
